This is a speech given by a Wisconsin mother, at the March 2, 2012 signing of a Food Declaration of Independence. Hundreds of citizens were present on this occasion, to rally behind a farmer who is standing up for our human rights to consume foods of our choice.

Hi!  My name is Jenny. Several years ago our family was looking for local raw dairy from healthy animals that graze on nutrient rich soil. However, we had a dilemma. We live in a city and can not keep dairy animals at our house. So we contracted with Grazin Acres and Vernon Hershberger to care for our animals. This private contract between farmer and member owners has been a very satisfying way for our family to enjoy the benefits of animal ownership and access high quality food.

My contract with Grazin Acres is perfectly legal under current WI law. Government regulations do not apply because I am not engaging in commerce. I am the owner of the animals. This also means that regulatory agencies such as the Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) have no jurisdiction over any of the food that I receive from my animals. Yet, these truths have not prevented DATCP from pressing criminal charges against Vernon Hershberger.

I hope we all ask ourselves…. when you are accused of a crime you have not committed; when you provide a service protected by the constitution; when you live by your conscience and God’s laws; when hundreds of individuals depend on you; what else can you do, but peacefully resist the forces of tyranny. Vernon Hershberger’s actions reflect his understanding that this debate isn’t just about raw milk or Grazin Acres farm club. It is so much bigger than that. It is about our fundamental rights, which include being able to choose the foods that we put on our table and nourish our bodies with.  These are rights that we do not need to establish.  My right to choose this healthy, unprocessed food is a God-given right that belongs to every individual.

A relevant example of American’s loss of basic rights occurred at the end of January in North Carolina. The Carolina Journal reported that a West Hoke Elementary School girl’s homemade lunch, which consisted of a turkey and cheese sandwich, banana, potato chips and apple juice, did not meet US Department of Agriculture guidelines.  This led to her lunch being supplemented with a school lunch that supposedly would meet USDA requirements. However, the end result was that this girl had only 3 chicken nuggets for her lunch and her homemade lunch went home untouched. The North Carolina state regulations read, “When children bring their own food for meals and snacks to the center, if the food does not meet the specified nutritional requirements, the center must provide additional food necessary to meet those requirements.” This family was denied the right to choose the food that they eat. The freedom to drink raw milk is the focus today, but whatever is on your dinner plate will be tomorrow.

The individuals who make up our government and regulatory agencies have no God-given authority or constitutional right to interfere in the personal decision of food choice. The constitutionally defined purpose of the national and state governments is to defend individual liberties, not deny people the freedom to choose their food, and deny them access to their property, in this case the milk from our own cows. However, in a recent decision, Dane County WI Circuit Court Judge Partick J. Fiedler stated, “Plaintiffs do not have a fundamental right to produce and consume the foods of their choice”. We are all losing the freedom to choose the food we eat. As Thomas Jefferson said, “Experience has shown, that even under the best forms (of government) those entrusted with power have, in time, and by slow operation, perverted it into tyranny.” What Jefferson warned against is occurring today. Therefore, we must be constantly vigilant in order to maintain our fundamental freedoms. I hope for our childrens’ sake, we awaken and see that the current loss of our liberties is catastrophic to the future of America.

  1. The government has no business interfering in this arrangement, yet they are trying to put Vernon Hershberger in jail when no law has been broken, and no one has been harmed. Except Vernon Hershberger, and those innocent families that keep their animals at his farm.

    This Wisconsin department is a disgrace to Wisconsin, indeed, a disgrace to all humanity. Shame on them.
