Raw Milk Activist Achieves Important Court Victory

Max Kane won in court today. This young father has found himself up to his eyeballs in legal wrangling with his state over his defense of the rights of citizens to agistments (cow boarding, herdshares) and private, unregulated trade.

He got a reprieve from the judge in his tiny town of Viroqua today, and the State of Wisconsin was denied their motion to compel Max to testify in a deposition, which appears to be part of a broader sting operation against traditional farms in the state. The Court denied the State’s Motion to Compel and granted Max’s Motion for Stay of Order Pending Appeal.

Max and his attorney, Elizabeth Rich are currently working on his appellate brief.

At issue is the farm fresh dairy trade, which up until last year was a flourishing part of rural life, and a boon to small farm economics. It appears that at the urging of the FDA, Wisconsin started a crackdown last summer, which has devastated a number of farm stores financially, and left large numbers of farm patrons without the food they had come to depend on.

Sally Fallon Morell, President of the Weston A. Price Foundation is a big proponent of whole, unprocessed milk for nutritional benefits. She also says it is the key to unlocking rural prosperity in the U.S.

Max hopes he can eventually get a ruling on the constitutionality of his states attempt to control unprocessed dairy sales between private individuals.

It is unfortunate that our agricultural officials are not promoting growth of the emerging small farm sector. Spying on the citizenry is never a popular move. They are missing an opportunity to “know their food and know their farmer,” in a good way!

    Yay! I hope this is the beginning of the turning of the tide for our farmers. They really could use a break. I’m very, very relieved for the Kane family.

    This is great news! Thanks for sharing. I hope the judges have more sense than the regulators as Max continues his struggle. The regulators are wasting loads of precious tax dollars that should be spent on much better things … like helping small farms instead of putting them out of business.

    As someone who believes that Raw Milk needs to be in every refridgerator – all I can say is thank you for sharing this!

    My family and I switched to Raw Milk about a year ago… we did a test run for about two months, then went back to the garbage you find at your local grocery store… The difference in how you feel before and after you switch is like night and day. I suffer from severe seasonal allergies and when I’m drinking local raw milk, I don’t suffer AT ALL! My IBS is nearly non-existant, and I feel 1000% healthier than ever!

    Anyone that tells you that Grocery Store – Over Pasturized – Ultra Homogenized Milk is good for you should have their head examined.

    Oh – yeah – one thing you CAN’T do with Grocery Milk that you can with Farm Fresh? If it sat around too long, Grocery Store milk sours… what can you do with Raw Milk? Make Biscuits Of Course!!! Love it! Thanks for supporting your local farmers, I do every week!
